آوریل 13, 2023This Electrical Installation Contract (the “Contract”) is entered into as of [Date] (the “Effective Date”) by and between [Name of Contractor], located at [Address] (the “Contractor”), and [Name of Client], located at [Address] (the “Client”).
- Scope of Work. The Contractor shall perform all labor, services, and materials necessary for the installation of electrical systems and equipment (the “Work”) at the Client’s premises located at [Address] (the “Premises”). The Work shall be performed in accordance with the plans and specifications provided by the Client.
- Time for Completion. The Contractor shall commence the Work on [Start Date] and shall complete the Work on or before [Completion Date]. The Contractor shall use its best efforts to complete the Work within the time specified, but time shall not be of the essence.
- Payment. The Client shall pay the Contractor the sum of [Contract Amount] for the performance of the Work. Payment shall be made as follows:
a. [Percentage] of the Contract Amount upon execution of this Contract.
b. [Percentage] of the Contract Amount upon completion of [Milestone].
c. [Percentage] of the Contract Amount upon completion of the Work.
- Changes. The Client may request changes to the plans and specifications provided that such changes do not increase the cost of the Contract by more than [Percentage] percent. The Contractor shall not be required to perform any changes to the Work unless a written change order is issued by the Client and signed by both parties.
- Warranties. The Contractor warrants that all materials used in the Work shall be new and of good quality, free from defects, and in accordance with the plans and specifications. The Contractor further warrants that the Work shall be performed in a good and workmanlike manner and in accordance with applicable codes and regulations. The Contractor shall correct any defects in the Work that arise within one year from the date of completion of the Work.
- Indemnification. The Contractor shall indemnify and hold harmless the Client from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of or in connection with the Contractor’s performance of the Work, except to the extent caused by the Client’s negligence.
- Insurance. The Contractor shall maintain insurance coverage as follows:
a. General liability insurance in the amount of [Amount], with the Client named as an additional insured.
b. Workers’ compensation insurance as required by law.
- Termination. Either party may terminate this Contract upon [Number] days’ written notice to the other party. Upon termination, the Contractor shall be entitled to receive payment for all Work performed and materials furnished up to the date of termination.
- Governing Law. This Contract shall be governed by and construed in accordance with the laws of the [State/Province/Country] without regard to conflicts of law principles.
- Entire Agreement. This Contract contains the entire understanding of the parties with respect to the subject matter hereof and supersedes all prior negotiations, understandings, and agreements between the parties. This Contract may not be amended except in writing signed by both parties.
